By obtaining, using or paying for any content from the Imanaka Interiors, the client agrees to be bound by and comply with all the terms and conditions of this agreement, your statuary rights are unaffected. If the client does not agree with any of the applicable terms, do not obtain or use any content from the Imanaka Interiors.

No person under the age of 18 years may purchase from Imanaka Interiors without written permission.

DEFINITIONS

The term, Imanaka Interiors, or Imanaka, ‘us’, ‘we’ refers to the owner of the website.

Copyright is an intellectual property right. It is an automatic right afforded to a creator for their lifetime and an extended period after their death. The type and length of protection given varies from country to country but generally gives the creator of a work, economic rights of control over copying, adaptation, distribution of copies, performance and broadcasting. It can also give moral rights of paternity (the right to be identified), integrity (the right to object to any derogatory treatment of their work), privacy and the right not to have a work falsely attributed.

The client shall mean the party for which professional services are rendered.

The content of the pages of this website is for your general information and use only. Imanaka Interiors reserves the right to revise the Terms and Conditions of its service any time without prior consent to its customers. All changes to the Terms and Conditions shall be effective immediately.

These Terms and Conditions do not affect the customer’s statutory rights. The use of this website or any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales and EU.

All artwork(s) on this web site, purchased artwork(s) and the website itself are protected by UK and EU copyright laws. The copyright of artwork remains with Imanaka and the artist or any other stake holder, even after the ownership of the artwork is transferred to the customer.

While it is your responsibility to obtain license before reproducing your chosen image, we will do everything we can to help this process.

CREDIT

The Client shall ensure the credit to the Imanaka and where applicable, the other copyright holder(s) is given in relation to every picture used. The credit shall be clearly visible near the reproduction or cited on the appropriate credits section.

GUARANTEE

Imanaka Interiors takes each step of the order process from order placement to dispatch very carefully to ensure the safe arrival of the artwork at the customer’s address. All deliveries are made by special delivery (i.e. recorded and signed for with next day delivery guarantee within the UK) by Royal Mail or equivalent, for EU deliveries except the next day guarantee; deliveries to EU from the UK will take 2-4 working days.

All artwork is packed to the highest standards to preserve the artwork at every stage of handling and delivery. All artworks are insured to the full order value.

The very nature of art is that every art item made by its artists is unique. Even with the same design of e.g. wood carved mirrors, the artist creates each mirror of the same design with some variations. These variations are normal and also they present the uniqueness of each work. E.g. Hair of Artemis is made of a tree branch and is displayed on our website. If you wish to place an order for Artemis, in case that particular art item has been sold, then it will be made to order. you should bear in mind that the artist will find another branch of that tree but not exactly the same shape. Nature presents us with its unique versatility that artists use, sometimes as a media for her/his creativity and imagination.

Each ‘made to order’ wood artwork, i.e. mirrors, sculptures, is represented by an image of previously finished work. As wood is a natural material and all wood relief art items are 100% hand-carved, the appearance of the finished work cannot be identical with the image however representative of the image displayed on the website.

Commissioned goods are those ordered to be made to your specification.. For commission work, clients will accept that they will rely on the artistic creativity and imagination of the artist, Clients shall document their expectations and requirements by knowing that creativity and imagination cannot be only restricted to definitions, it may go beyond the definitions. By placing an order for commission work, our clients are considered to accept this very nature of commission work. However, the artist will communicate with the client at every possible stage depending on the requirements of the clients.

PAYMENT/PRICING

All prices include handling, packaging, shipment and insurance cost, where applicable import tax, and if applicable VAT at the current rates.Payments must be received by Imanaka Interiors for the confirmation of order and to proceed further. Clients are notified by email for the confirmation of order upon receipt of payment by Imanaka.

To make the payment, we accept most major credit cards including Visa, Master Card, AMEX and PayPal. Imanaka Interiors reserves the right to add a surcharge of 5% of order value per order for credit card payments as this is what we are charged for using this service.

CANCELATION /RETURNS

Cancellation of orders must be made in writing or by email to email address

Cancellation can be made within seven working days of receipt of artwork as per Distance Selling Regulations for UK and EU.

Return shipment cost of art items with full insurance is the liability of customer. The order value is fully refunded when the returned item is received and is judged to be in “as new” condition suitable for further resale. In the event that the item is damaged or worn in such as way that in no way could it be resold then depending on the amount and nature of the damage the customer may or may not receive a partial or full refund, in this case it will be discussed so that an amicable solution can be found.

Artwork ordered to your specification is nonrefundable except in the circumstance that they are unfit for purpose or outside the original description of the order.

RESOLUTION OF QUALITY ISSUES/DISPUTES

Any quality issues affecting client satisfaction adversely will be handled carefully and immediately in order to resolve them as soon as possible.

We take all measures in our power to assure the quality at every step of ordering process for client satisfaction and communicate these measures with our clients at every step. However should any unforeseen problems occur; this will be dealt with in the following steps:

Receipt of complaint by client via telephone, email or in person

Documenting the problem and sending a copy to the client to ensure that the nature of the problem is communicated effectively understood by both parties and in full detail

Identification of the cause(s) of the problem and who should take responsibility

Disposition to resolve the issues to be agreed by both parties.

The cost of resolving quality issues will be shared between the responsible parties.

In case of a dispute between the parties, the resolution of the quality issue will be arbitrated by a third, independent body.

CLIENT CLAIMS REGARDING THE DELIVERY (LOST OR DAMAGE)

Our clients receive their art items either by Imanaka Interiors or the artist sent directly to the client from abroad. Imanaka Interiors and artists (by contract) use only reliable courier companies and methods of shipment (guaranteed and signed) and art items are insured to the full price during all stages of order processing.

These claims shall be handled by Imanaka Interiors in direct contact with the courier company. Once client claim in a written form has been received, the Imanaka Interiors will contact the courier immediately and apply for compensation. For damage and/or part loss claims, the damaged contents and all the packaging must be retained and presented to Imanaka Interiors by the client for proof upon request. The claim should also include any available supporting information / evidence relevant to the claim. Imanaka Interiors shall inform the client with every stage of developments during the claim process until the finalization of the claim application.

GOVERNING LAW and JURISDICTION

These Terms and Conditions shall be governed by the laws of Britain & jurisdiction of British courts or the Jurisdiction of the relevant Imanaka Interiors office.This Agreement and any listed restrictions constitute the entire agreement between the parties with respect to the subject matter hereof and merge all prior and contemporaneous communications. This Agreement shall not be modified except by a written agreement signed by a duly authorized representative of the Imanaka. provided that no purchases or order of similar documents issued by the client shall modify this Agreement even if signed by the Supplier. If the Imanaka’s performance of any of its obligations here under is delayed by labor dispute, act of nature,or any other matter not within the Imanaka’s reasonable control, then the date for performance shall be extended by the time of such delay. If any provision of this Agreement is found invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable according to its terms. Accordingly, the parties agree that if any provisions are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable and in such manner as comes closest to the intentions of the parties to this Agreement as is possible. This Agreement will inure to the benefit of and be binding upon the parties, their successors and assigns, except that the client may not assign or transfer this Agreement without the Supplier’s prior written consent. No term of this Agreement is intended to confer a benefit on, or to be enforceable by, any person who is not a party to this Agreement.

These terms supersede any other versions of the Imanaka Interiors’ Terms and Conditions before 1st of July 2012.
